1. Acceptance of Terms

By downloading, installing, or using Markahead, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.

2. Description of Service

Markahead is a personal achievement tracking application that allows you to:

  • Record daily accomplishments and assign point values
  • Organize achievements with categories and tags
  • View reports and analytics of your progress
  • Export your data in various formats
  • Optionally analyze achievements using AI

3. User Data and Privacy

  • All your data is stored in your private iCloud account
  • We do not have access to your data
  • See our Privacy Policy for complete details on data handling

4. Acceptable Use

You agree not to use Markahead for any unlawful purpose or in any way that could damage, disable, or impair the app or interfere with other users.

5. Intellectual Property

Markahead and its original content, features, and functionality are owned by Markahead and are protected by international copyright, trademark, and other intellectual property laws.

6. Third-Party Services

Markahead integrates with third-party services:

  • Apple iCloud - For data storage and sync (subject to Apple’s terms)
  • AI Services - For optional achievement analysis (subject to the AI provider’s terms)

Your use of these services is subject to their respective terms and conditions.

7. Disclaimer of Warranties

Markahead is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

We do not warrant that the app will be uninterrupted, error-free, or completely secure.

8. Limitation of Liability

In no event shall Markahead, its developers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data
  • Loss of profits
  • Business interruption

This applies regardless of the theory of liability, whether in contract, tort, or otherwise.

9. Data Loss

While we design Markahead to work reliably with iCloud, we are not responsible for any data loss. We recommend:

  • Enabling iCloud backup on your device
  • Using the app’s backup feature to create periodic backups

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to this page. Your continued use of Markahead after changes constitutes acceptance of the modified terms.

11. Termination

We may terminate or suspend your access to Markahead immediately, without prior notice, for any breach of these Terms of Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer operates, without regard to conflict of law provisions.
